Prisons and terms of incarceration are managed by the government and not by free market. This critique should be addressed to the legislature and not to capitalism.

They are not separate and that is the problem. That separates “crony capitalism” or “corporationism” from “free market capitalism”.
Either way, the critique is to be addressed to the legislature. It is the government that ultimately allows for such pathological situation to exist.
